1. Introduction

Welcome to Giftabull LLC.

By accessing or using the Giftabull website, mobile application, or services (“the Platform”), you agree to these Terms and Conditions (“Terms”). Please review them carefully before making a purchase or using our services.

Giftabull sells physical precious metals — small gold and silver— intended as personal gifts or educational keepsakes. All sales are of tangible products that are shipped directly to the purchaser or designated recipient.

Giftabull does not hold, store, or manage any metals for customers. Giftabull is not a custodian, financial institution, broker-dealer, investment adviser, or money-services business.

2. Nature of Products

2.1. Giftabull sells physical gold and silver bullion as retail merchandise.

2.2. Each purchase results in the immediate sale of a physical product, delivered to the customer or gift recipient.

2.3. Giftabull does not issue digital, fractional, or account-based representations of precious metals.

2.4. Giftabull products are not investment vehicles, securities, commodities contracts, or derivatives.

2.5. All products are sold for personal, gifting, or educational purposes only.

3. Compliance with U.S. Law

3.1. Giftabull operates in compliance with applicable U.S. federal and state laws, including but not limited to:

• The USA PATRIOT Act and anti-money-laundering regulations (31 C.F.R. § 1027);

• Federal Trade Commission (FTC) e-commerce and advertising standards;

• State and local business licensing and consumer protection laws.

3.2. Giftabull’s business model involves retail sales and direct shipment of goods. It does not involve storage, account balances, or investment offerings.

3.3. Giftabull does not provide investment advice, solicit investments, or manage financial accounts.

3.4. All content and educational materials are provided solely for informational and financial-literacy purposes.

4. Customer Eligibility

4.1. To make a purchase or use the Platform, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction);

• Have legal capacity to enter into a binding contract;

• Provide accurate information for order processing and verification.

4.2. Giftabull reserves the right to verify identity or payment information to comply with KYC (Know Your Customer) and AML (Anti-Money-Laundering) standards.

4.3. Orders may be canceled or delayed if verification cannot be completed or if suspicious activity is detected.

5. Ordering, Payment, and Pricing

5.1. All prices are based on current market spot prices plus applicable retail premiums, service fees, and shipping costs.

5.2. Prices are final at checkout; due to live market fluctuations, pricing cannot be adjusted after purchase.

5.3. Accepted payment methods include credit/debit card, or other approved processors.

5.4. Giftabull does not offer financing, margin, or installment purchases.

5.5. Orders are binding once confirmed and payment is processed. Cancellations are not permitted after confirmation.

6. Subscription and Payment

This should include details about the monthly and yearly subscription plans and the benefits included in each subscription.

Subscription options are monthly or annual. Monthly subscription to be charged $8.99 and automatically renewed monthly until cancelled. If cancelled before monthly renewal, user will have subscription until completion of month that was paid for. Annual subscription to be charged $79.99 and automatically renewed annually until cancelled. If cancelled before annual renewal, user will maintain subscription until completion of the year that was paid for. Subscription can be cancelled at anytime however subscriptions that are cancelled before expiration date will not receive refunds, they will remain in effect until expirati

2. The ability to track value of more than one gift.

3. The ability to add multiple gift recipients to receive and track unlimited gifts.

7. Shipping and Delivery

Most orders ship between 2 and 5 business days. Delivery times may vary due to supply and demand. You will receive order confirmation and shipping details promptly after purchases. Giftabull is not responsible for delays or losses caused by carriers, customs, or force-majeure events.

8. Gifting and Transfer of Ownership

7.1. When gifting through the Platform, the purchaser authorizes Giftabull to process the order and ship the item directly to them or the recipient they provide.

7.2. Ownership of the product transfers upon successful delivery to the purchaser or designated recipient.

7.3. Giftabull does not maintain custody or hold title to any products after shipment.

9. Returns, Refunds, and Exchanges

Due to the market-sensitive nature of precious metals, all sales are final.

Precious metal purchases, including gold and silver bars, are final and non-refundable due to market-based price fluctuations and the nature of these physical products. Once an order is placed, it cannot be canceled, returned, or exchanged. By completing a purchase, you acknowledge and agree that all precious metal transactions through this app are final and that no refunds will be issued under any circumstances.

10. Taxes and Reporting

9.1. Customers are responsible for any sales taxes applicable in their jurisdiction.

9.2. Giftabull may collect and remit sales tax where required by law.

Giftabull complies with all federal and state reporting obligations.

11. Risk Disclosure

10.1. The market price of precious metals fluctuates.

10.2. Giftabull makes no representations or guarantees regarding appreciation, resale value, or future price.

10.3. Giftabull’s products are not investments and should not be purchased for speculative or investment purposes.

10.4. Historical pricing data is provided solely for educational and informational purposes.

12. Intellectual Property

11.1. All trademarks, images, software, and design elements on the Platform are the property of Giftabull LLC or its licensors.

11.2. Users may not reproduce, distribute, or use any content without prior written consent.

13. Limitation of Liability

12.1. Giftabull shall not be liable for any indirect, incidental, or consequential damages arising from the use of its website, app, or products.

12.2. Giftabull’s total liability is limited to the purchase price of the order giving rise to the claim.

12.3. Giftabull disclaims all warranties, express or implied, regarding the suitability of precious-metal products as investments.

14. Indemnification

You agree to indemnify and hold harmless Giftabull LLC, its employees, officers, affiliates, and suppliers against any claims or losses arising from your misuse of the Platform or violation of these Terms.

15. Privacy and Data Protection

14.1. Giftabull collects only the personal information necessary to process transactions, verify identity, and comply with legal obligations.

14.2. Data is processed under Giftabull’s Privacy Policy, available on the website.

14.3. Giftabull does not sell or share customer data with third parties for marketing purposes.

16. AML / KYC Statement

Giftabull may require government-issued identification for certain transactions.

Giftabull does not accept or hold customer funds beyond the purchase transaction period.

17. Governing Law and Dispute Resolution

16.1. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

16.2. Any dispute shall be resolved through binding arbitration under the rules of the American Arbitration Association in Delaware.

16.3. Each party waives the right to a jury trial or class action.

This app is intended for use by adults, such as parents and legal guardians, and is not designed for direct use by children. Children under the age of 13 are not permitted to create or manage their own accounts, and any information related to a child’s profile must be entered and controlled by a parent or guardian. We only collect a minimal amount of information about children—typically a name and, optionally, an age—solely for the purpose of personalizing the experience for the family. We do not deliver advertising directly to children. By using the app, you confirm that you are an adult user and that you will manage any child-related information responsibly.

Giftabull does not provide financial advice. All precious metal gifts are physical products. Spot price tracking is for educational purposes only. Prices at which gold and silver are purchase by the purchaser may fluctuate based on spot prices at the time of purchase. A service fee will be included in purchases for users that don’t have a subscription. Giftabull LLC is not an investment platform. The Giftabull app is not a financial account or brokerage service.

Amendments

Giftabull may revise these Terms at any time by posting an updated version on the website. Continued use after updates constitutes acceptance of the new Terms.
